If probate is refused, the court may make an allowance to be paid out of the estate of the decedent; if the probate is granted, and it shall appear that the contestant had reasonable cause for contesting the validity of the will or codicil, the court may make an allowance to the proponent and the contestant, to be paid out of the estate

It is important for taxpayers to investigate the decedent’s basis in inherited property; unless the beneficiaries can provide information about the decedent’s basis in the property, the law presumes that the basis of the inherited property is zero, resulting in substantial capital gains tax liability for beneficiaries who sell the inherited property
