Whenever you are facing a legal crisis, GET LEGAL ADVICE FROM YOUR OWN ATTORNEY!
An elderly couple discovered that they were victims of real estate fraud — they went to the Prosecutor’s Office, and were told by an assistant county prosecutor not to make payments on the fraudulent transfer or they, too, could be implicated.
When they followed that advice, the mortgage company foreclosed on their mortgage. Now, several years later, their new attorney pleads: “Exceptions should be made for people who are [older] and who are subject to this kind of fraud.” But, apparently the judge responds: “Why now?”
Unless a miracle happens, she will go to live with her family; and he will go to jail, because he will not vacate the house voluntarily. Such is the shocking story reported in: Hillside couple protests judge’s decision, by Erin O’Neill, for The Star-Ledger.
Newspaper reports are not always the most accurate; and we may not know all the relevant facts; BUT, the lesson to be learned is: whenever you are facing a legal crisis, GET LEGAL ADVICE FROM YOUR OWN ATTORNEY, as soon as possible. Do not just depend on, perhaps well meaning, individuals who are not dedicated to exploring your particular set of facts and how those facts interrelate with the applicable law.
